a. This Policy complies with the Australian Privacy Principles (APPs) set out in the Privacy Act 1988 (Cth) and other relevant Australian laws and regulations.

3. Appointments
3.1 About Appointments
3.1.1. This section concerns the provision of appointments booked for consultation services through all online portals, telephone, and referrals.
3.1.2. By engaging the services of the Company, the Client acknowledges and agrees to be bound by these terms and conditions.
3.2 Non-Registered Agent Disclaimer
3.2.1. The Company may engage individuals who are not registered with the Office of the Migration Agents Registration Authority (OMARA) to assist in the provision of services.
3.2.2. Any individual not registered with OMARA, hereinafter referred to as “the Non-Registered Agent”, shall only provide information that is publicly available and shall not offer advice or services requiring registration with OMARA.
3.2.3. The Client acknowledges that in the absence of an OMARA registered agent, any information provided by the Non-Registered Agent is not to be relied upon for visa applications, migration matters, or other legal purposes.
3.2.4. The Company disclaims all liability for any harm, loss, or damages arising from the reliance on information provided by the Non-Registered Agent.
3.3 Engagement of Registered Migration Agent
3.3.1. The Company may engage the services of an OMARA registered agent, hereinafter referred to as “the Registered Migration Agent”, to provide consultation and advice on immigration matters.
3.3.2. The Client acknowledges that the Non-Registered Agent may attend appointments to liaise with or bridge communication with the Registered Migration Agent.
3.3.3. The Client agrees that any advice or services provided by the Registered Migration Agent shall be subject to separate terms and conditions as agreed between the Client and the Registered Migration Agent. The client will be provided an service agreement and it’s validity will start only after the agreement is counter signed by both parties and payment is made in full for the mentioned service(s).
3.3.4 The Registered Migration will be bound by the code of conduct relevant to the industry.
3.4 Limitation of Liability
3.4.1. To the fullest extent permitted by law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising out of the engagement or reliance on services provided by the Non-Registered Agent.
4. Intellectual Property
All content on the Site, including but not limited to text, graphics, logos, images, and software, is the property of Visa Help Services or its licensors or agents and is protected by Australian and international copyright laws. You may not reproduce, modify, distribute, transmit, or otherwise exploit any of the content without the prior written consent of Visa Help Services. The Site and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by Visa Help Services, its licensors, or other providers of such material and are protected by Australia and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
4.1 Associating Bodies: The logos displayed on the associating bodies in the website’s home page may be used because at least one or any of the employees employed by VHS are provisional/full members or subscribers of that body. In this case, the subscription of the company is not necessary unless otherwise advised to us.

In no event will Visa Help Services, its affiliates, licensors, service providers, employees, agents, officers, or directors be liable for damages of any kind, under any legal theory, arising out of or in connection with your use, or inability to use, the Site, including any direct, indirect, special, incidental, consequential, or punitive damages, including but not limited to, personal injury, pain and suffering, emotional distress, loss of revenue, loss of profits, loss of business or anticipated savings, loss of use, loss of goodwill, loss of data, and whether caused by tort (including negligence), breach of contract, or otherwise, even if foreseeable.

However, Visa Help Services cannot guarantee the availability of staff at all times, and therefore cannot be held liable for any loss or damages resulting from the unavailability of staff due to circumstances beyond our control, such as illness, emergency, or other unforeseen circumstances. In the event that staff are unavailable at the time of your scheduled appointment, Visa Help Services will make every effort to reschedule your appointment at the earliest mutually convenient time.
17. Registration Status of Staff
While Visa Help Services employs experienced staff to provide services to our clients, we cannot guarantee that all staff members are registered with relevant legal bodies at all times. Visa Help Services will make every effort to provide you with accurate information regarding the registration status of staff members, but we strongly advise that you independently verify the registration status of any staff member before accepting any advice or information provided by them. You acknowledge that Visa Help Services will not be held liable for any loss or damages based on provided general suggestions or without signing an agreement with us in connection with our services. We assure our paid services are in line with laws and regulations. However, publicly available information shared with you as part of general counseling requires your own caution.
